Ex-federal prosecutor Andrew Weissmann called House Judiciary Committee Chair Jim Jordan’s (R-Ohio) recommendation of criminal charges for former special counsel Jack Smith “preposterous.”

In an interview on MSNOW with Jen Psaki, Weissmann added, “You cannot read this letter and in any way view this as perjury.”

He is referring to Jordan’s accusation that Smith made false statements to Congress when he was deposed late last year about his investigation and prosecution of Trump. During the hearing, Smith was asked whether he had subpoenaed the text messages of members of Congress which he denied.

Smith did review the texts of lawmakers but received the messages through the White House. Jordan did not think Smith was candid enough and is recommending the prosecution of the man who led the criminal cases against President Trump.

“He was asked, did you get the content of text messages from members of Congress through a search warrant? Did you get the content of text messages of members of Congress through a search warrant? To which he said, no, I didn’t,” Weissmann recalled.

Rep. Jamie Raskin (Md.), the top Democrat on the panel, confirmed Smith did not subpoena members’ text messages but rather compelled the National Archives to turn over the communications of White House staff.

“They did not even ask whether Mr. Smith’s team had ever reviewed text messages from Members. Jack Smith could not have lied because Republican Members never even asked the question their theory is based on,” Raskin wrote in his statement.

“That is 100% truthful,” Weissmann agreed. “The fact that Jack Smith also got documents from the national archives was not asked in any way, shape, or form.”

“I usually am more careful to say, you know, it seems like or we don’t know everything they have. You cannot read this letter and in any way view this as perjury,” Weissmann continued.

Under Trump, the Department of Justice (DOJ) has pursued other prosecutions against political opponents, including New York Attorney General Letitia James (D) and former FBI Director James Comey.

The DOJ is also reportedly looking into a case for perjury against E. Jean Carroll, a writer who accused President Trump of sexual assault.

Smith in an interview on MSNOW’s “Deadline: White House” has said it “angers” him to see public servants who work on cases that aren’t favorable to Trump or his allies “demonized for doing their jobs” by the Trump administration.
