Fox News and businessman Kevin O’Leary are being sued by a group opposed to data center construction in Utah, alleging it aired false statements about their funding.
The suit, brought against the network and television pundit by Alliance for a Better Utah, Elevate Strategies, Gabrielle Finlayson, Taylor Knuth and Josh Kanter, alleges that O’Leary used the network to “go on the attack,” and make false claims about what he said was the group’s ties to China.
“Fox was instrumental in O’Leary’s defamatory smear campaign, putting him on air to attack Plaintiffs five times in three weeks. Despite O’Leary’s inherently unreliable claims, and his clear lack of support for them, Fox repeatedly invited O’Leary onto its programs and allowed him to broadcast his false accusations to millions of viewers without any qualification,” the suit reads.
The network last month publicly apologized for remarks O’Leary made on its airs and distanced itself from his comments saying it was “aware of no evidence that they are funded by, or acting in the direction of, or in coordination with Chinese interests in opposing Mr. O’Leary’s project.”
“Fox News Media publicly corrected the record on every program where on-air guest Kevin O’Leary’s comments were made, all of which was extensively publicized,” the network said in a statement to The Hill on Thursday. “We will vigorously defend against this lawsuit.”
O’Leary’s comments, made during an appearance on “Mornings with Maria Bartiromo” in May, came as he described China as an “adversary” that wants “us to stop building our electrical grid.”
In a social media post last month, the pundit did not apologize for his comments but said he “would like to clarify that I have no evidence that Alliance for a Better Utah, Elevate Strategies, Gabrielle Finlayson, Taylor Knuth or Josh Kanter are funded by China or the Chinese Communist Party.”
